Nurture Makes Euthanasia More Acceptable Essay Euthanasia is the practice of mercifully ending a persons life in order to free someone from a deadly disease. The Greek word â€Å"Euthanasia† simply means â€Å"good death†. This refers to the intentional ending of a person or animal’s life to relieve suffering and pain. It is also known as â€Å"Mercy Killing†. It is a serious ethical and political issue in today’s society because it goes against the norms of traditional medicine. It is so, because some people define euthanasia as a form of suicide. However, some people actually think that it is a choice that concerns the quality of life. In fact, people have different standards regarding the worth of life. Others believe that being clinically alive is enough to say that a person should live, but for others, it is simply inadequate. If a person’s life is lacking in self awareness or intrinsic presence as a human being, due to extreme physical or mental suffering, then that person should be able to choose a dignified death rather than an undignified existence. This is evident because of moral conscience, social bias or pressure, and financial situations. It is portrayed that nurture or environmental factors plays a role that make euthanasia more appealing. In short, some people tend to disregard the moral and ethical values of life when they see a person suffering. Indeed, despite of the moral and ethical issues that contradict the concept of euthanasia, there are certain factors it impacts society positively, which leads it to be more socially acceptable. One factor that makes euthanasia more acceptable is because of moral conscience. It is argued that euthanasia is not considered as a good practice because it weakens the society’s respect for life. It is believed that all human beings are to be valued despite of their age, gender, sex, religion, social status and their potential for achievement. However, some people who have a different perspective in regards to conscience oppose this idea. Moral conscience urges a person to do well and avoid evil. In this case, the evil that is being measured in this view is prolonging the suffering of a dying person. Also, the act of accepting to end the suffering of a person is a responsibility that is caused by conscience, which does not violate the purity of life. One of the writers from the book Euthanasia, John Shelby Spong, says that conscience really does play a role in making a decision between mercy killing and natural death. He explains that: â€Å"In the past, when medical care was rudimentary and death seemed to be entirely in the hands of God, the issue of euthanasia was simpler. Humans had little technology that could prolong life. In modern times, however, science endows doctors with previously unimagined powers to keep a body alive even when that person no longer has any quality of life. I believe that assisting in such a person’s suicide does not violate the sanctity of life. However, to prevent people from being victimized by family members who could profit from death of a relative, safeguards need to be established. These include requiring people to have living wills specifying the extent of treatment they want in the event of a serious accident or illness and requiring hospitals to have a bioethics committee to help decide on issues of euthanasia†. 1 In short, moral conscience helps out a dying person to finish his or her suffering. In contrast, they must take into consideration that they can only perform euthanasia if the person dying agrees to get it done. Through this, people are actually respecting the choice of the dying person since being human also means being respected. Being able to respect a person’s decision, it also builds a relationship between the person dying and the person who is witnessing the suffering. This now creates a social bias between the people around them since people tend to persuade what they think is right. This is another factor that makes euthanasia more acceptable. Social bias or pressure is defined to be a prejudicial attitude towards a certain race, culture, gender, color, age, group and religion. It also tends to change a person’s perspective, attitude, and values to conform norms. From the book, Euthanasia: The Debate Over the Right to Die, Seamus Cavan says that: â€Å"According to this argument, the very fact that a person is in the end stages of a terminal illness makes it unlikely, if not impossible, that his or he decision to die could meet any of the proposed criteria. They point out that being in the end stages of a terminal illness is by definition an extraordinary situation that makes it difficult or impossible to make rational decision†. It explains that, people in such a position, they argue, are already faced with all kinds of pressure that make it more likely that they will choose death. They may be extraordinary pain. They may feel humiliated or degraded by their inability to take care of themselves. They may feel as if they are a burden to their family or loved ones, in either an emotional or financial pressure to end their life so as not to incu r further medical costs. They are quite likely to be depressed, in the medical sense, by their situation and thereby unable to think clearly. Their judgment may be clouded by pain or medication. Also, social bias does really affect a person’s decision when it comes to euthanasia. It is appealing because there is an evident sense of personal responsibility and braveness made by the dying person to relieve their own pain. When they think this way, they tend to make it positive for the people around them, instead of prolonging their agony. Even though, it will be hard for the people around the dying person to accept his decision to die, it is still respected. Financial situations, like social bias, also play a role in making euthanasia more appealing. Financial situations are also considered as one of the factors why euthanasia should be more practiced by people. Financial situations are part of euthanasia because some people cannot afford to pay the medical bills of that person. This is much evident especially in 2nd and 3rd world countries because some people don’t earn enough money from their jobs to pay the prices of their hospital bills. In this case, it is considered to be in a form of a passive euthanasia. Passive euthanasia occurs when a patient dies because medical professionals either don’t do something necessary to keep a patient alive or stop doing something that can keep the patient alive. People who suffer from poverty, for example, might not be able to afford life-sustaining drugs or life-saving operation that would extend someone’s life. Passive euthanasia may also occur if doctors turn off a life-support machine or disconnect a feeding tube, which is the only means of keeping a person alive because unfortunate people can’t afford it. These actions may be carried out at the request of a dying person or their legal representative, who is often a family member. Dr. Mark from the article Alive and Kicking also says that: â€Å"As people in developing countries learns about euthanasia, they are requesting it as a way of out of the misery of poverty and hopelessness†. 3 These people believe that it is only through euthanasia that will help them save money and discontinue the suffering and pain of this person. In this concept, it is a win-win situation because both have compromised to be free from suffering physically and financially. All in all, it is important to note that the levels of these factors come into information whether it can be personal, environmental, or financial. It is shown that nurture does affect the views and perspectives of people when it comes to euthanasia. Considerations have to be made whether the position from one of these areas is even acceptable. It is so, especially with the separation of the views between the dying person and society. The three factors that were mentioned earlier must be considered thoroughly in order to see its impact to be positive. In the current world of rationed care and economic rationalism, it is not hard to imagine a situation where the availability of euthanasia becomes seen as a cheaper, easier, rational option to providing intensive support, community living and care for those who wanted and needed it. There is no doubt that euthanasia brings a positive factor that opens the options for people. Certainly, euthanasia has factors that deal with society that makes it more acceptable.

To identify the barrier facing by contractor of implementing Occupational Safety and Health Act 1994 and Factories and Machinery Act 1967 on construction site. To identify the implement of Occupational Safety and Health Act 1994 and Factories and Machinery Act 1967 on actual construction site. Background The OSHA Malaysia is effective on 24 February 1994(Act 514). An act is to ensure safety, health and welfare of persons who are at work and to protect other person against safety risk or health in connection with the activities of persons at work. (Occupational Safety and Health Act 1994 (OSHA), s.1) OSHA 1994 actually is quoted Occupational Safety and Health Act. The objects of OSHA 1994 have written and are under section 4. An object of OSHA1994 is to secure the safety, health and welfare of persons who are at work and to protect persons at a place of work other than persons at work against hazards. Not only for that had the act also had to promote an occupational environment for persons at work which is fit to worker physiological and psychological needs. The last object of the act is to provide way or method according related to the occupational safety and health legislations can be gradually replaced by an institution of regulations and permitted the industry codes of practice operating in combination with the provisions of the statute, designed to maintain or improve the safety and health standards. (OSHA, s.4 (a-d)) FMA 1967 (Act 139) is to provide for the control of factories with respect to matters relating to safety , health and welfare of person therein, the registration and inspection of machinery and for matters connected therewith. Those machinery which is high risk for operate such as mobile cranes, tower cranes and etc must be certified and inspected by DOSH. (Factories and Machinery Act 1967 (FMA), s.1) According to DOSH government website mentioned that, all factories and general machinery must be registered with DOSH before they can be installed and operated. Factories or any companies require to use machinery their must require to obtain a permission to install machinery by submitting relevant documents to their nearest DOSH offices. The permission to install machinery is for each time certificated machinery or new auxiliaries installed. Secondary source is get information from documents such as personal records, service record, books, journals, newspaper and etc. Primary source are few methods such as questionnaire, interview, case study and etc. (Kumar, 2005, p: 118) For this research title is relative with safety and health requirement therefore the secondary data source will obtain a lot of information which is collected from book, relevant title of articles and relevant record publish from the departments of occupational safety and health. The objective one and two of this research paper which is to study of Occupational Safety and Health Act 1994 and Factories and Machinery Act 1967 the effectiveness by contractors to implement at construction site and to identify the barrier facing by contractor of implementing those two acts at construction site. The first objective can be achieved by reading those two acts to understand which should implement by the contractors. The second objective can be achieved by reading more books to find out the effectiveness and barrier that contractors may be facing when they implement the two acts at construction site. In addition, questionnaire is appropriate primary data source to get information for this research paper. Because of the research is time-limited and questionnaire is the easiest and quick methodology. Open question is the respondent could be answer in their own words. This open question can be generated mainly qualitative data. The advantages for open question are providing depth and valuable information provided by respondent able to expressing their own opinions. Respondents have the opportunity to express themselves freely, resulting in a wider variety of information. (Kumar, 2005, p: 132) According to Kumar (2005) stated that questionnaires restricted two basic types of question there are closed-ended which called as closed question and open-ended or called as open question. Closed question is researcher set out the answer such as yes or no and let the respondent to answers. Although there is a disadvantages of closed question which is not enough of depth and variety of the information obtained, sometime the answer provided are not truly reflect respondent their own view or opinion. Through the closed question for questionnaire is to ensure that literature view the view and ideas that is appropriate for respond from the respondents. For this research paper will be total 100 sets of questionnaires given to respondents regarding objective two and three will be set for the question. The respondents could be contractors, site staff, site agent, project manager and other parties which experience and knowledge for safety and health at construction site. Guides to Research Report In this research paper will be content total five chapters. Chapter 1 is the introduction and problem statement of the research title. Then is the aim and objective of the research paper. The aim is achieved by through implemented the objective that have be set out. Chapter 2 is the literature review is through reading more articles and books or other resources which are concern to the research title and obtain the similar idea for those sources and write out the literature review base on the objective stated. Chapter 3 is research methodology for this research paper will carry out the questionnaire. The target of the respondents will be contractor and persons who are related to construction site. Those questionnaires will be set out 100 sets and data will be collected base on this stage which mean in this chapter. Chapters 4 are analysis the data and carry out the result of the analysis in chapter. After the result had been analysis the issues can be identified from the findings. Those data will be presented by using bar chart and etc. Chapter 5 will be the last part of the research paper. This chapter will be conclusions and recommendations after those progresses had been gone through. This chapter also is to ensure that the research aim has achieved through implementing those three objective and the recommendations will be suggested in this chapter. CHAPTER 2: LITERATURE REVIEWS Introduction Occupational Safety and Health Act 1994(OSHA) and Factories and Machinery Act 1967(FMA) is a legislative framework in Malaysia construction industry to give promote to the construction industry, advance and assist to have better or high standards of safe and healthy working culture. The legislations are enforcement by Department of Occupational Safety and Health (DOSH). The DOSH are under Ministry of Human Resources Malaysia. The department is agency of government to enforce those legislations to promote and enhancing Malaysia construction site quality of working life. (Mudrikah, 2010) In this research paper, the method to reducing the accident rate in construction industry is Contractors have to implementing with the strict safety and health regulatory frameworks for preventing, monitoring and reporting adverse events for the construction site. Contractors should comply with those effective safeties and health requirement to effectively minimize the accident happen on construction worksite. (Dorji et al, 2009) Problems and barrier to implement of OSHA 1994 Table 1 showing that construction industry is among the highest accident rate and fatalities industry in Malaysia occupational rankings. The highest accident rate and fatalities happen in construction site one of the reason may because the act is not effective and there have a little bit of legal loophole. Before amend the OSHA 1994 section 29 safety and health officer there is no penalty. But after amended become the OSH (Safety and Health Officer) Regulations 1997 and OSH (Safety and Health Officer) Orders 1997 have a penalty if the contractors do not comply to employ competent person as safety and health officer and other duties in ensuring such personnel could perform his duties effectively and define class of industry to appoint competent safety and health officer both are penalty same condition which is maximum RM5000.00 or maximum six months imprisonment or both. Section 29 has been amended by the Minister to OSH (Safety and Health Officer) Regulation 1997 after amended stated that any building operation and any work of engineering construction when the total contract price of the construction project which is exceeding twenty million of ringgit Malaysia the contractors should employ a safety and health officer or other duties in ensuring such personnel could perform his duties effectively at the construction site. (Safety and Health Officer) Order1997. (Occupational Safety and Health Regulation 1997, s.29) Some of the construction project the total contract sum may not exceeding twenty million according to OSH (Safety and Health Officer) Regulation 1997 mentioned that, means contractors is not necessary to comply and appoint the safety and health officer on their workplace. If unfortunate accident happened cause site workers injury or death at construction site is that whether should be the negligence of the contractor because his has full comply with the OSHA or the legal is indeed imperfect because only the project exceeding twenty million of ringgit Malaysia contractor should to appoint a safety and health officer on the construction site. According to OSHA (Safety and Health Officer) Regulation 1997 regulation 18 duties of safety and health officer his had a important duties at the construction site one of it is to advise contractors measure of the site workers their interests of the safety and health and their responsibilities also included to inspect the workplace determine whether any machinery or equipments or process of work may have the chances liable site worker injuries or harmful their body. If accident is happen safety and health officer have to submit report informs on the number and types of accidents which had occurred in the workplace to the Department of Occupational Safety and Health (DOSH) according to OSHA (Safety and Health Officer) Regulation 1997 regulation 19 stated. Since section 29 of OSHA had been amended mentioned that only total contract sum exceeding twenty million construction projects is required to appoint a safety and health officer. Moreover, the workplace is happen any accident, dangerous occurrence, occupational poisoning or occupational disease which has occurred or may have chance occur on the workplace according OSHA section 32 to inform the nearest DOSH office. If accident had occurred which is construction project not exceeding twenty million total contract sum who are going to take safety and health officer his duties to report the accident happen on workplace to DOSH is that means small project is not an accident happen. The purpose of reporting of accident incidences to DOSH is to ascertain the root causes and enable to take remedial actions for prevention future occurrences similar condition. The report incidence is important database for DOSH the database is to analyze strategic planning, management and law enforcement for improving and prevention for accident can be minimize in future. The data recorded by the safety and health officer is required in order to analyze the results of unification and to ensure statistical validity. (DOSH, 2004, p: 4) Safety and health organization shall be implementing by the contractors those person are profession and get training for safety and health programme. Those safety and health officer with qualified their role are provide appropriate advice to the site workers their responsibility for the safety in the site and to promote and encourage the planning and implementation of the necessary and effective measures in minimizing the risk and to reduce the accidents rate. (Construction Confederation, 2008) The problem may be arise if contractors they do not appoint safe and health officer or site safety supervisor there is no professional person at worksite to train for new site workers or instrumental promote a safe and healthy working environment on workplace. Furthermore, most of the site workers are foreigners like Indonesia, Pakistan, Myanmar, Bangladesh or etc. Those foreigner workers they may be lack of knowledge to protect themselves. They might never been exposure with the construction not to mention that they have experience to cope with the huge construction projects. Therefore, the bad attitude and behavior is belonging to the construction it will then rapid increasing the accidents rates. (Wee Lee, 2010, p: 22) According to Wee Lee (2010) his article mentioned that, there may have another legal loophole in Malaysia. Malaysia safety and health officer they do not have autonomy power therefore they cannot strictly implement the regulation in the construction site. Moreover, the safety and health officer is employed by the contractor. The contractors may tend to hiding the accident occurrence on site and do not comply with reporting accident happen on their site or even threatened their safety management staff do not report to DOSH that is because the accident of worker may make lost productive time. DOSH officer may come over the construction site which had happened the accident to do inspection for the accident areas. The construction site accident rate has been increasing simply because of these unhealthy practices in Malaysia. (Wee Lee, 2010, p: 15) Although appoint a safety and health officer of construction site have effective reduce the risk of accident rate. But according to Rabani (2010) mentioned that many contractors they are not aware the important role for appoint a safety and health officer at construction site. Therefore, many contractors they neglect to appoint a safety and health officer to the construction site. (Rabani, 2010, p: 3) According to Kit Keng (2004) mentioned that, when the accident happen at site it may cause contractors suffer losses in term of the productivity and affected their profit. Accident happen may lower down the productivity this may simply because of the site workers may because their co-worker happen accident cause injury or death which may affect their physical and psychological fear they were worry to become the next victims. Therefore, may occur a shortage of workers on site because they may do not want to work in an accident workplace. That is why cause the construction work delay and cannot be completed on time. Contractor will suffers losses and affect his profit due to paid site workers to work over-time to speed up the works and completed at schedule time. In fact, poor safety background actually will cause high insurance premium according to Kit Keng mentioned contractors there are always think that as long as he had buy a insurance to protect themselves from the direct losses caused by the accident happen at construction site, but actually some of the contractors they do not really know that how much had his paid to the insurance premium. Lastly, some of the contractor thinks that safety and health officer is not necessary for employ at his workplace. But as a matter of fact the contactors should employ a qualified persons act as safety and health officer. (OSHA, s.6 (1)) In addition, according to OSHA 1994 Section 16 have been revised to OSH (Employers Safety and Health General Policy Statements) (Exception) Regulation 1995 by the Minister. The section 16 had been amended that, if the organization has more than five employees than the employer and self-employed person has their duty to formulate the safety and health policy. (Occupational Safety and Health Regulation 1995, s.16) However, the OSHA 1994 section 16 had been modified become better and detail for the need of safety and health policy. But after amend the act from pervious penalty maximum RM5000.00 or maximum two years imprisonment or both become not penalty required for the Regulation 1995 which mean the safety and health policy is not an important for the construction site and site workers. In case, the contractors did not provide the safety and health policy to their workers is without any penalty. (CIDB, 2010, pp: 20-21) According to Kit Keng (2004) mentioned that, the barrier to the implement safety and health requirement at construction site is because the employer seen the safety and health requirements required a big visible cost to implement and employer do not want to paid for it. This may be one of the reasons caused that the contractors cannot implementation the safety and health requirement on the construction site. Therefore, they often do not comply with the legislation requirement in their workplace as provide the safety and health organizations. Conclusion given the above problem is the OSHA 1994 it still contains a little bit of problems and the contractors have the excuse to bypass some of the responsibilities that he should comply with and implementing at his workplace to reduce the accident occurred at the site. Effective to implementing OSHA 1994 Construction industry is highest hazard among all industry therefore to effective minimize the accident rate and fatalities the construction project should through a good planning and co-ordination before the construction project start. Therefore, the contractor plays an important role to implement safety and health responsibility from the concept to the construction completion. One of the effective ways to implementation the safety and health requirements is bring in safety and health in early stages is incorporate safety and health into tendering stage. Therefore, contractors are required to demonstrate that they have an appropriate safety and health management system and to verify its implementation in practice and his required to comply with contract specific occupational safety and health requirement. (CIDB, 2010, pp: 4-5) Effectively to minimize the accident at construction site is to select potential contractors which are appropriate evaluate the safety and health for the projects. Implementation the safety and health planning included in contract like PAM Contract 2006. According to PAM 2006 contractors his received letter award his is entitles to starts construction works at site his is required to procure and submit contractors all risks insurance, workman compensation and performance bond to the architect or quantity surveyor before the contractors only allowed commencing the construction works. If the government can implementation that the safety and health planning must be bound together or including inside before allow commencing the construction work then all the employer they are not able have the excuse to exist if not comply with that the construction project is not allow to start commencing they construction work then may causing the employer lose of their profit. Although OSHA 1994 and FMA 1967 is able to take legal action but bound the safety and health include in contract will be more effective. Because of contract is binding that able enhance strict to implementing safety and health through taking legal action. Profit is the goal of most business is actually the construction industry is also had the same goal. The way to effective reducing the accident for the construction site may through using approach prevention of injuries and death with implementing occupational safety and health management system. (CIDB, 2010, p: 42) According to Kit Keng (2004) mentioned that contractors seen the visible larger amount for implementing the occupational safety and health management system in his construction project but implementing the safety and health management systems is effectively reducing of injury and death at construction site and benefits to contractors his are achieved through avoidance of delay to his construction project in order to increase his profit as early as completion of the construction project. According to CIDB (2010) stated that, occupational safety and health management system had mentioned about the safety and health policy. Which means the safety and health policy is need for the construction workplace. The safety and health policy is to introduction the safety and health program for all among the construction site workers. The safety and health policy shall always up-to-date and get aware to the site workers. Contractors have the duties to revise the written statement of the safety and health policy and planning to implement the policy that had amended and deliver the information to the site workers. (DOSH, 2007) All parties at the site work together to achieve and prevention of the accidents with minimize at site will be the purpose of the safety and health policy. Besides, implementing and establish a safety and health committee if the situation is build a condominiums it may have forty or more than forty workers including those staffs hired by employer or workers supply by the sub-contractors in this case the management chain will lead to more than forty worker being hiring or work on the construction project. (Wee Lee, 2010, p: 13) Contractors should implement to form a safety and health committee because there are a lot of workers at the construction site. Otherwise, the contractors get instructed by the Director General of DOSH that the workplace is required that to form the safety and health committee. Both employee and management are represented for the safety and health committee this is to keep on reviews the construction site conditions. Because of lack of reviews conditions on worksite there may affect worker on site or public surrounding their safety and health. (OSHA, s.30) According to OSHA section 29 and 30 actually contractors should employ a full time competent person act as safety and health officer and then establish a safety and health committee at construction. Safety and health committee must be keeping on reviews the construction site condition. Therefore, at least once every three months the safety and health committee shall conduct periodical inspection and audit on site and provide essential advice on safety issues besides drafting and improving the companys OSH guidelines and procedure. (Rabani, 2010, p: 47) (OSHA, s.29, s.30) Introduction of FMA 1967 Contractors not only had the responsibilities to comply with the OSHA 1994 but Contractors had the obligation need to comply with the FMA 1967 too. FMA 1967 mainly is applying by factories and construction site. The Contractors should understand more about the Factories and Machinery Act 1967, which will help the contractors able to implementing the act on the construction site. This is responsibility of the contractors to maintain all their machinery which is appropriate and safe to operating condition and provide with implement safety measures in construction site operations.(Rabani, 2010, p: 52) Besides, the FMA 1967 section 36 and regulation 7 of FMA (Notification, certificate of fitness and inspection) Regulation 1970 stated that any of the machinery should get permission to install the machinery on construction site is required certificate of fitness. According to FMA 1967 section 35 stated that, any construction project should involve using machinery or plant to carry out the construction work. Only in the case that the construction project is able completed in a period less than six week and does not need or involve using any machinery for their construction project then the contractor is does not require to notify to DOSH. FMA 1967 Section 56 have been revised to FMA (Building Operations and Works of Engineering Construction) (Safety) Regulation 1986 by the Minister. (FMA, s.56) Part I regulation 3 Application stated that these regulations are applied by the building operations and to works of engineering construction. Section 56 Regulations have total 17 parts divided showed in arrangement of regulation. (Factories and Machinery Regulation 1986, r.3) In this research paper was discussing about the construction project which contractors should implementing to minimize the machinery hazard cause site workers injury and death at construction. Therefore, in this research papers will be focus on Part II General Provisions. Statutory of FMA 1967 Since table 1 showing that construction industry is the highest accident of fatalities rates. Therefore, machinery at construction shall also to consider and comply with FMA 1967. According FMA regulation 1986 regulation 25 appoint a site safety supervisors to inspecting and rectifying any unsafe place of work and correcting any unsafe practice on construction site this is to ensure the safety , health and welfare of site workers. Appoint a site safety supervisor will be same requirement with safety and health officer which is person who is qualification. Site safety supervisor there must have at least minimum of two years site foremen experience. Purpose to appoint a site safety supervisor is to check the sub-contractors work which is to ensure the sub-contractors have comply with the Malaysia legislation. If the contractor appoint a part time site safety supervisor and the particular part time site safety supervisor shall spend at least fifteen hours per week and promoting safe conduct of work at construction site. (Factories and Machinery Regulation 1986, r.25) Otherwise appoint a part time site safety supervisor if the construction site employed more than twenty site workers on workplace contractors shall appoint a contractors safety supervisor. The contractors safety supervisor shall spend at least five hours per week and promoting a safe conduct to his site workers. Contractors safety supervisor requirement will be same with site safety supervisor with at least two years site foreman experience and qualification. (Factories and Machinery Regulation 1986, r.26) Some inconsistencies in OSHA 1994 and FMA 1967 in this part the FMA stated the construction work site which is employed fifty persons or more than it shall establish a safety committee but in this part of OSHA are stated employed forty or more than forty workers the contractors shall establish a safety and health committee. In fact, it should be the same consistent for establish a safety and health committee. The safety committee members will be both employee which mean including sub-contractors and contractors and also management members to be represented. Purpose for safety committee is to keep and review safety and health condition in workplace. (Factories and Machinery Regulation 1986, r.27) The safety committee shall appoint senior member of contractors staff at construction site and the safety committee shall consist the site safety supervisor, the entire contractors safety supervisors and others site worker. The safety committee should meeting at least once a month. (Factories and Machinery Regulation 1986, r.27) Furthermore, contractors should implement strict on machinery installed rules on FMA Regulation 1986 regulation 6 just like machinery installed on any floor above the ground floor there have a regulation to control over like any floors above the ground of any building or structures are not allowed to use machinery. Only if the floor or structure has been designed or constructed there are able to support the loading of the machinery or additional strengthen purpose then contractors is allow to use or operate the machinery on the particular building or structures. Contractor should maintain their machinery which is always in good and safe condition his is require to ensure around the machinery surrounding meaning that the passenger walk way is free from any loose material or non-slippery condition. This is to prevent those site workers would not fall down towards to the machines and caused injury or death. According to this regulation 6 if the contractors are not comply with it his will be fines not exceeding RM2000.00. Besides, slipping is easy to happen on construction site. Therefore, Contractors should make sure the surfaces of the passageway sanded or covered or removed. If any passageway such as platform, scaffold or otherwise of elevated working surface is slippery and causing the workers fall down found out is the negligence of the contractor they do not provide slip-safe footing to minimize the slipping hazards on the construction safe according to the FMA Regulation 1986 regulation 8 the contractors would be penalty not exceeding RM2000.00. Contractors have the obligation to keep or remain the worksite passageways with do not have any dirt and debris or other obstruction object may cause site workers tripping. Contractor should minimize those accumulations of dirt and debris on worksite by instructed his site agent to maintain for it and site agent is contractors representative on construction site. In addition, the debris shall be handled and disposed-off by a method which will not harmful to person and the debris is not allow to accumulate is may constitute a hazard to the worker on site.( Factories and Machinery Regulation 1986, r.22) Moreover, contractors should also have to ensure at worksite there is do not have any projection may or could cut site workers if any, contractor or his representative should removed it or made safe to prevent site workers injury or death. (Factories and Machinery Regulation 1986, r.9) Construction site the most important is provide workers a safe access to workplace. Firstly, contractors must ensure the construction site provided proper stairways; ramps or runways. Lynn Armstrong Composition II Illustration Essay 11 March, 2014 O Captain! My Captain! Walt Whitman was a 19th century American poet who changed the rules for writing poetry. He is one of my favorite poets because he was bold enough to openly talk about sexuality and same sex couples in his works during a time where such things were looked down upon and even banned. He also aided the nation to understand and face the grief they felt after the loss of a respectable and loved authority figure. With O Captain My Captain, Walt Whitman captures the contrasting duality of the times; both triumphant and mournful in nature. Of all of his colorful, imaginative poems this one in particular resonates with me because the poet's heartbreak is so real and apparent in the poem's somber and pleading tone. This poem begins energetically, in the first couplet although it does not introduce you directly to the subject of the poem. What we know is that a ship commanded by an unnamed captain has come back from a voyage, which has apparently been dreadful. (Terrinino) I can perfectly imagine the ship being meant to symbolize America during the Civil War and the damage caused by it. Also, the prize that was won is obviously the victory of the Civil War. While in the second couplet, "The port is near, the bells I hear, the people all exulting, While follow eyes the steady keel, the vessel grim and daring:". This passage comes off particularly enjoyable to me because it talks about the men finally coming home from the war and the enthusiasm that awaits them when they get home. It has been a long, perilous journey for the soldiers. I don't have to try to imagine that they are excited about finally being able to be reunited with their families because ... ...es the steady keel, the vessel grim and daring; But O heart! heart! heart! Mathematical Interpretations of Keynes’s General Theory

IntroductionMany changes had occurred in the last century in every science. Economics was not the exception and a transformation into the theoretical approach took place in the 30s. In 1936 Keynes published â€Å"The General Theory of Employment, Interest and Money†. Its main ideas set the foundations of macroeconomics and had influenced economics since.Unfortunately, Keynes had (and has) a bad reputation as a writer, because of this there has been constant analysis and interpretations of what he meant. Economists affirmed that Keynes’s innovating work, as any new approach, had some â€Å"inconsistencies†. Further, the book had small use of mathematics and, thus, had small proof of what it stated. Therefore, these ideas need interpretation and testing into the â€Å"real world†.Keynes Main IdeasKriesler and Nevile (2000) define the book’s main points as follows:  Ã¢â‚¬Å"†¦in a capitalist economy employment, and hence unemployment, is determin ed by effective demand [†¦] decisions about production and investment are made on the basis of expectations†, and â€Å"monetary variables influence real variables such as output and employment and real variables, in turn, influence monetary ones.†One of the most daunting tasks was to set up a mathematical foundation of the cited Keynes’s works. The most important economists who performed this job were, in a â€Å"crossed fertilization process† as Heller (2000) points it, Roy Harrod, James Meade and mainly John Hicks. In fact, in 1937 Hicks published an influential article, â€Å"Mr. Keynes and the Classics: A suggested interpretation† that rapidly became the standard of Keynesian economics theory.Mathematical FoundationsThe Keynes’s ideas stated in the paragraphs above turned â€Å"into simple mathematical models of the macro-economy; [and] the most long-lived and flexible, the â€Å"IS-LM model†, came from John R. Hicks† (Morgan 2001). Despite that, some authors suggest that Harrod and Meade had inspired the IS-LM model proposed by Hicks (Young, qt. in Heller, 2002)[1]. Others suggest that Champernowne and Reddaway also had some contribution into the model’s formalization (Barens 1998, qt in Heller, 2002)Besides the multiple interpretations of Keynes’s work, Hicks’ one remains as one of the most important.As pointed by Heller (2000), the models proposed as explanations had similar expressions which are systems of simultaneous equations. And the mathematical formulation’s success of Keynes’s General Theory is because of the â€Å"mathematical elegance† and the exact nature of systems of simultaneous equations, which many consider alike; and particularly to Hicks who was the only one in representing the theory through diagrams. (Heller, 2002)As pointed, Harrod was another economist who performed a mathematical foundation for Keynes’s work. According to him, Keynes system corrects the traditional theory; allowing the Income level to be not given, the price level does not depend on the money, and money demand is divided in two. Due to all of this Harrod states that Keynes system is better than the traditional one. Keynes had a very positive view of Harrod’s development of his own work, which Harrods presented in the same conference where Hicks did. Hence, Keynes thought that Harrod works interpreted correctly his own ideas.But these authors’ success in interpreting Keynes’s ideas is not free of detractors. Kriesler and Nevile (2000) made a clear stand of this: economists reject the â€Å"IS-LM framework as being neither a valid simplification of the arguments in the General Theory nor a reliable model for analyzing macroeconomic issues.† Economists think the IS-LM model ignores expectations and it is not useful to analyze a particular economy beside the static equilibrium[2]. They also affirm that Hicks t ook Keynesian macroeconomics to another direction from the one intended by the work’s author.   The same authors assert that Keynes’s own vision on Hicks model â€Å"did have the faults that post Keynesians typically ascribe to IS-LM.†[3]ConclusionKeynes’s work and the posterior mathematical development gave, to governments and to economists, answers that can be easily explained and understood by everyone only using analytical tools as diagrams or simple mathematics. What is more, those ideas were beyond the economic â€Å"common sense† of the time: governments can spend during depressions.  Affirming if these formalizations of the model are what Keynes’s work pointed might be intimidating. Regardless of this and the different views, Hicks simplification and formalization of the model is useful, and catches the spirit of the work. Issue of Immigrant child in Canada Essay

During the recent years, there has been extraordinary raise in the number of immigrants in Canada. Asians cover the largest group of the recent arrivals to Canada. During 1986 and 1991, there were 819,000 immigrants in Canada of whom 19 percent of them were children under the age of 12 years . (New Canadian children). At present, Asians are the fastest growing population in Canada. Asian immigrants include Indians, Chinese etc. , of whom Chinese make the greatest number of Asian immigrants in Canada over the past 20 years. (Asian Canada). In 2003, Chinese comprise of 17. 3 percent of Canada’s immigrants. The Government of Canada is providing many facilities for such immigrant children. Despite of the facilities and the help given by the government of Canada, the Chinese immigrant children in Canada are facing many problems which include language problem, family income, school learning system, food style, living environment, cultural change, etc. , The teaching style in the Asian nations and Canada are quite different from each other. (Researcher debunks) Chinese immigrant children in Canada face many problems in the school due to the teaching style and the language problem. Because Chinese value traditional ways of schooling, power imbalance occurs in between the teachers and the immigrant parents. Parental involvement is very important to the children whose native language is not English. (Parental involvement). Chinese immigrants who came to Canada recently are facing barriers to communicate effectively with the school personnel. Chinese parents communicated with the teachers or school personnel only two to four times a year where as the non-immigrant parents communicated once in a month and even once in a week. (Home school communication). This happens because of one of the common reason that the Chinese parents cannot speak English and need to rely on the interpreters. The other reasons include non-availability of the school letters, school programme schedule and also with the lack of time. The immigrant children feels much pressure on the new education system. When the home language is Chinese and English being the medium of instruction in the school, the child finds it very difficult to adjust and could not understand the concept when compared with the non-immigrant child. The children because of the language problem to communicate with other people, could not mingle with other children and find hard to make friends. If the immigrant child has friends in the school, it makes the child to develop communication skills as well as the interpersonal skills. This effects the child’s mental development. When the child is physically and mentally happy and supported by the parents and the society, then that child becomes successful in the future. There are several reasons which leads to the vulnerability of new immigrant groups in Canada. Some of them are inability to speak dominant language, separation from community, negative public attitudes, and lack of knowledge of the health care systems. Poverty can be calculated using product of education and occupation but this may not be true with the immigrant situation. Most of the immigrants have more formal education when compared to Canadians, they often face underemployment and unemployment. Due to the instability in the income, their children are affected. The parents cannot provide them with good educational facilities, quality food, and all other necessities as compared with the non-immigrant children. Due to the low functioning capacity of the family, the children suffer from the mental disorder, stress, conduct disorder, hyperactivity etc. These children are psychiatrically disordered. These affect the education, games and other activities of children when compared with the non-immigrant children. The immigrant children also includes the children of the single parent family status. These families are usually accompanied by low education, low income, and there is a high risk of mental and physical health problems. The development of the child completely depends on the parents and the society. Children of alcoholic parents have high risk of developing psychiatric disorder. However, according to the report by Offord and Lipman, the disorder rates among the new immigrant children are lower. (Growing up Canadian) Immigrants start their adaptation to the new country through a process called acculturation. (Acculturation/adaptation). An individual who is a participant in culture contact situation and when a person is being experienced by the external culture directly, it is known as psychological acculturation. The result or conclusion of acculturation is adaptation but this method includes stress which affects both immigrated parents and children. Expectations of both the new and old culture on the immigrant children show much burden. The acculturation affects the Chinese immigrant children in internal domains such as aspirations and values and external domains such as social experience and the living environment. The meeting of the two cultures takes place in several levels to the immigrant Chinese children. The fore most level would be the cultural practices and beliefs, social experience and the parental expectations. Chinese culture is completely different from that of the western culture. Asians give importance to the needs and rights of the group of people and they believe in interdependence. But these principles are incompatible with the western culture where they believe in the individualism, personal growth and individual achievement. Certain amount of discontinuity concerning cultural contexts and values of their new and previous homelands are shown on the recently immigrated Chinese children. By the cultural discrepancy, the immigrant Chinese children feel acculturative pressure from both sources like schooling and peers. The immigrated Chinese children will be unwilling to stick to the parental norms due to the pressures of the new culture. The cultural values to which the immigrant children are used to in their homes would conflict with those of the values and beliefs of the western culture. However, the immigrant children stay different from the non-immigrant children in their values. The immigrant children have their own norms and values which are important in the practise of daily life. The immigrant Chinese Children experience discrepancy in the food they eat usually because the food which Chinese eat is completely different from that of the western nations. The immigrant Asian children have been found to achieve higher academic performances and the parental aspirations are high when compared to non-immigrant parents. Chinese immigrant children may thus locate themselves between the parent’s high expectations and comparative poorer aspirations of the new culture. A source of concern over the Chinese-Canadian community is the racial discrimination. According to the leaders of the Chinese-Canadian community, the immigrant Chinese children have not only been ostracized but also they have been subjected to physical and verbal attacks. These attacks were unacknowledged by the schools and the teachers. Adolescents and the immigrant Chinese children have been the unknowing sufferers of violence. The immigrant Chinese children were the targets of different forms of discrimination. Due to this the immigrant Chinese children experienced complicated social relationships even in the school where the children feel alienated and isolated. The immigrant high school Chinese students feel much difficult and socially isolated in their English classes. Encounters with discrimination and racism are very common among the immigrant Chinese children. Thus the difference between the parental expectations, cultural beliefs of their country and the new host country would confuse the immigrant children regarding their aspirations and personal values. The Chinese immigrant children experience bias based on race and so they have diminished sense of belonging to their school communities. In Canada, the immigrant disabled child is not treated properly. Canada is violating Rights of the child as well as the seven articles of the united nations conventions. The disabled immigrant children in Canada are not guaranteed social and basic educational services. Canada is violating the rights of the immigrants by refusing the children with disabilities. Disability is understood as a political issue rather than the personal issue. The provisions under immigration and refugee protection act (IRPA) and the original immigration is best known to the poor treatment of people which was later enacted to replace in 2002. Canada’s system of immigration does not recognise children with disabilities but rather gives importance to the economically desirable workers. The immigration of a disabled child depends on the how independent the children could be when they grow up. Even now, the Government of Canada is admitting disabled immigrant children only in some of the cases. If the government does not give permission for the disabled child to get immigrated, the child goes through tough times which spoils his career. The Government of Canada is providing certain programs which help the immigrant children to build up English language and adjust with the school environment. These programs include ESL, LINC etc. , ESL stands for English as a Second language. (ESL in Canada directory). ESL means teaching English to a person whose primary or native language is not English. Education laws in Canada provide that ESL should be provided to all of the students who have been enrolled in the schools and whose primary language is not English. ESL programs in secondary and elementary schools are designed in such a way to meet the needs of the children to meet the proficiency standards. It focuses on English alphabet and phonetics to the children of all ages. In cooperation with the local school boards and colleges, community and immigrant organisations, the Government of Canada offers French and English language training programmes. This is known as LINC. LINC stands for Language Instructions to Newcomers to Canada. (LINC programs) Intergovernmental cooperation helps territorial and provincial governments to put forward to members of official-language minority communities to provide education in their own language. (Intergovernmental Cooperation) British Columbia literacy program for the immigrant families/children have been released for the immigrant families with young children. The immigrant PALS (Parents As Literacy Supporters) is made for the for the pre-school children and the parents living in Canada for at least three years. The Government of Canada provide education to the immigrant children through the language schools. Language schools are the schools where foreign languages are studied. Language schools offers certain specific programs to the people wishing to prepare for internationally recognised language exams such as TOEIC, TOEFL, University of Cambridge ESOL examinations, DELE etc. The immigrant Chinese people comprises most of the population in Canada. The immigrant Chinese children are facing many problems in the society, school etc. , and they are often confused with the culture and customs of the new and previous homelands. They are also experiencing bias based on race, language and food and they stand socially isolated. Despite of these problems, the immigrated Chinese children are achieving higher academic performances. The Irony of Socrates Essay Socrates was thought to be ahead of his time. At the time, the citizens of Athens believed that their government had the ultimate power and nothing could be higher. So of course when one person chose to believe another view, the government became a part of the situation to maintain a sense of peace thorough the nation. This didn’t sit well with Socrates. He wanted as many people to know about his knowledge as possible because he had found scientific reasoning as to why his way was true, rather than simply because government officials say it is. This strikes up multiple cases of irony from Socrates’s turn from natural philosophy to what eventually becomes what we know today as political philosophy. The first bit of irony arises from the fact that Socrates is actually writing to more than one audience, and also that he uses more than one strategy to do so. David Leibowitz, author of The Ironic Defense of Socrates: Plato’s Apolog, describes the audience situation, â€Å"Socratic irony has a twofold purpose and a twofold audience: conciliation of, and protection from, the unpromising members of Socrates’ audience, and the education of the promising member in the audience† (p. 17). He then explains the strategies he used to get attention from each audience, â€Å"Irony, in the sense of self-depreciation and even flattery, is necessary for the first audience so that Socrates will be less offensive to them and more in tune with their moralistic views of the world. Irony, also in the same sense of speaking in a â€Å"double† fashion is necessary for the second audience because even â€Å"they start off under the spell of vulgar prejudice†Ã¢â‚¬  (p. 18). Socrates knew that if he wanted anyone to understand his beliefs that he would have to use certain techniques that would speak to the right group of people so he could have potential to be understood. Leibowitz’s descriptions go beyond the fact that you can say two different things to two different audiences. First, it clarifies the complexity of Socrates’ ironic strategies with respect to the unpromising members of the audience. And second, it effectively continues to portray the true character of Socrates after his death. The after death irony works well in two ways also. For the promising young, his words were remembered and reflected on so that they would be taught the truth about his life and his scientific investigations of truth so each individual could decide what to believe in for themselves. For them, it worked so that his knowledge would linger on so that they could follow his footprints to pursue his ideas of philosophy. As for the unpromising Athenians, â€Å"it served as a bitter pill, or rather a pill that begins to taste more bitter over time, as they eventually repent of their condemnation of a man who was obnoxious and annoying, but nonetheless brave and concerned with only virtue† (p. 156). His beliefs seem to make a lot more sense to society today so it truly is too bad that he was put to death because who knows what other theories or discoveries he may have been able to come up with in his lifetime that could have been put to good use in the future. The regret of the people of Athens clearly comes too late for Socrates, but it then becomes a protection service for Socrates’s other philosophical followers so that people could come to admire the nobility of philosophers. Socrates was said to have â€Å"unconventional truths† that he was trying to convey to his listeners (p. 3). The first is how lying has become so simple, but such a necessity in politics. Socrates thought through his choices when presenting himself to the Athens’ officials and came to the conclusion that it was easier and better for him to lie to them. It’s occasions like these that lead people to find the government to be unjust and corrupt, so they truly should never have been in position to had the power to judge Socrates and his choices to begin with. But Socrates knew of this before his trials and knew that telling them the truth would only be a hopeless defense since their minds were already made up before sentencing. Looking back, Socrates denied looking into or taking part in natural sciences, but as Leibowitz’s studies show, â€Å"he was actually hints that this is exactly what he might have done as a young philosopher, and he suggests that these investigations were profane 1 / 2 because they do investigate the gods and attempt to substitute necessity for divine will† (qtd. in Leibowitz, 2). This suggests that people’s beliefs about gods do not generate their beliefs about human morality, but more that their moral beliefs generate their thoughts and beliefs in gods. So it really takes learning what your personal morals are before you can find who you actually are in the religious aspect, whether you were raised on a certain religion or another. In conclusion, the irony shown here is clear in several ways including being able to write to two separate audiences in two different tones and also that Socrates was able to discuss his thoughts on unconventional truths. It’s ironic, and sad in a sense, that we felt a man with his knowledge was put to death because the government was unable to find that they weren’t the ultimate power. And to find that a lot of the knowledge that we know today began from the ideas of Socrates makes you wonder if we could have built more off of what we already know now to better ourselves in the long run. Discussions include developing a committee of oil producing nations to determine the supply and price of crude oil, for the benefit of importers in rapidly developing countries, and exploring acquisitions strategies to meet these needs. China and India have allocated a large amount of capital to research and development, consequently they are producing more innovations than any other countries in the world after signing the Indo-China Inter-governmental Science and Technology Agreement. These two countries are highly trained in the fields of science and technology which make them a diverse resource to outside countries wanting to utilize those talents. The reforms led to the expansion of fiscal decentralization, increased autonomy for state enterprises, the foundation of a diversified banking system, gradual liberalization of prices, the development of stock markets, the rapid growth of the non-state sector, and the opening to foreign trade and investment. Each in essence aims to develop awareness between people where a common cultural framework does not exist. This major form of expression needs to be addressed to even begin to understand another culture, but then it is closely followed by those things around us that we would use to describe a culture. English is used for most transactions, but the usage of English tends to change with the countrys context.   In order for the expatriate to learn to communicate in China, we will enroll them in a 3-month Survival Chinese course taught by Surfchinese.com. This course is designed to help the businessperson learn the essential communication for business circumstances.   The course progresses through three levels starting with Basic Communications such as, time schedules, business banquet, marketing, and business consulting. The Intermediate Level moves to business topics such as, business greetings, conversations in the office and trading.   The Advanced Level will progress to allow the use of Chinese to perform more complicated communications such as negotiations, presentations, or business meetings. Since these are online courses the expatriat can continue with the language training throughout the transition to China and as long as needed until they are competent in the communications needed for their professions. The overall process will take roughly 30 days, with some continuing education to follow. It is important for our managers to not only learn and understand the culture, but it is equally important for them to stay current with it. Having a good grasp will generate a higher level of respect, and that will generate a higher level of business. Documentary training 3 day training The initial phase will be a 3-day training phase, or 24 hours, covering the culture and what is acceptable through documentary training. Language, behaviors, and demographics will be topics discussed during this time. Proper greetings and gestures should also be mentioned here. A pre-test will be administered to gauge our managers knowledge, so we can tailor the training program to the level of knowledge of our group. A documentary training program about the countrys geography, economics, and sociopolitical history helps to show cultural differences between the home and foreign countries.   It is expensive to send the trainee abroad for training; it is more economical to train in the home country with videos and books to learn about the foreign culture. Cultural and field simulation trainings and exercises 7 days or 40 hours The second phase will be approximately 7 days or 40 hours of applying the knowledge received in step one through cultural simulation trainings and exercises. It will be the responsibility of those in the group to be active in the community, talk to the local people, and learn firsthand the quirks of the culture that has been taught to them. A short synopsis will be required pending completion of this phase to showcase real experiences and application of the lessons up to this point. Cross Cultural Simulations are easy ways to get people involved in learning about different cultures. It allows them to actually be immersed in the culture and experience what someone of a different culture may encounter in a new country. By allowing yourself to step into someone elses shoes, you are able to see the basic similarities, differences, obstacles, first impressions, and interact with culturally different groups. Simple simulations can be played such as how many ways can you come up with to say hello in different languages; the Story of my name, where you give an inside look into the meaning or origin of your name; case scenarios, multicultural games addressing counting, stereotypes, and English as a second language. Creating specific simulations can help others become more aware of the challenges faced and behaviors that may be primarily cultural, rather than natural. Instructions 1.   Ã‚  Ã‚  Make role playing cards depicting certain attributes for different cultures. Each person should get just one of the secret instructions to act out during the meeting. 2.   Ã‚  Ã‚  Tell the group they are to read their individual instructions by themselves, and not let anybody else know what they are. Tell them they should intentionally act the way their instructions indicate during the group activity. 3.   Ã‚  Ã‚  Role-play for about 20 min. 4.   Ã‚  Ã‚  At the end, allow at least 20 minutes to discuss the questions provided. The different cards that people are to follow should be specifically pertaining to an attribute of a culture. For example: You are someone from a cultural group that believes men and women should be separate. This in effect puts the player directing into the shoes of someone who is of a different culture. It allows them to see first-hand the challenges that can be faced, and ultimately allows them to see how they can be more accepting and responsive when faced with someone whose common practice is opposite of their own. After the meeting, you should allow for questions to be answered pertaining to: 1. How they felt during the exercise? 2. Describe what happened during the exercise. 3. What did you learn? 4. How does this relate to the real world? 5. What if you had known why the others were behaving as they did? 6. These simulations allow you to gain a firsthand experience of a different culture, but also allow you to make those mistakes that are inevitable between the mix of cultures. It allows you to address those mistakes or downfalls that may occur in a watered down version of a culture, and how best to handle those situations once they occur. Even though a full-blown culture experience will have unexpected situations that arise, this allows for highlights into a culture and the firsthand experience at what to expect. Implementation of the Plan The next 2 weeks or 13 days will be spent implementing some of the learned strategies to determine if any of them are viable. This encourages those that came up with the ideas and motivates those who did not. Hopefully, this will build a team atmosphere and establish who the true leaders are. During this time we will be able to evaluate where the company stands at this point in the training process. A closing test will be administered to recap the lessons learned and to promote continued practice of the new strategies. The next 7 days will be a research and development phase. This is a good time to have the group come up with a clever and creative way to market the business, and break into the scene so to speak. The group will start with a SWOT analysis, followed by a marketing plan, explaining in detail their ideas for market penetration. Spouse and family issues Another important area to address for any candidate who is incorporating their family into a cross-culture scenario is to provide the candidates family with sufficient training on the host country.
